67-year-old pensioners from the Kushchevsky district, Sergei and Irina Rybalchenko, recorded a video message addressed to the head of the Investigative Committee of Russia, Alexander Bastrykin, the country's Prosecutor General, Igor Krasnov, and the prosecutor of the Krasnodar Krai, Sergei Tabelsky. The couple complained that they are being deprived of their land under a fabricated criminal case. Several plots of land, contrary to law and logic, have already been handed over along with the harvest to Fyodor Streltsov, the holder of the Tsapkov gang's common fund, who fled to Ukraine. The Rybalchenkos are afraid for their safety, life and health, fearing physical violence. They handed over the video recording to their clients with a request to publish it if anything happens to them after the publication of this article. In the meantime, we will tell you everything that is known about the legacy of the Tsapkov gang in the village of Kushchevskaya. In 2009, Valery Vovnenko offered the married couple Sergey and Irina Rybalchenko 1,000 hectares of land in the Shkurinskoye settlement of the Kushchevsky district for 8 million rubles. The Rybalchenkos did not have that kind of money. And they ultimately offered to buy about 500 hectares of land to their good friends Evgeny Perepelitsa and Richard Pavlov. Valery Vovnenko was in charge of the re-registration of the land, convincing the new owners that the entire transaction was legal. At the same time, he set a condition that the land be registered to a local resident registered in the Kushchevsky district. Such a person was found - Sergei Mandrin. He became the nominal owner of part of the land. According to the Rybalchenko couple, he received various amounts of money for this. Another part of the land was owned by Evgeny Perepelitsa. Both he and Mandrin gave powers of attorney to Rybalchenko to dispose of all the land. And the land itself was leased to the Shkurinsky agricultural production cooperative in the first years after the purchase. 15 years have passed. And in May 2024, on the initiative of the regional Department for Economic Security and Combating Corruption of the Ministry of Internal Affairs, the Kushchevsky police opened a criminal case of fraud on an especially large scale (Part 4, Article 159 of the Criminal Code of the Russian Federation) against 67-year-old Sergei and Irina Rybalchenko. The basis was the denunciation of the aforementioned Sergei Mandrin. However, Mandrin preferred not to talk about receiving money for nominal ownership of land. The main point of the accusation against the Rybalchenko spouses was the order of the Kushchevsky District Administration of 1992 on the allocation of 166 hectares of land to Sergei Mandrin.

The Rybalchenko pensioners were in no way involved in this document. There were no signatures or interest in this decision. After all, the land was purchased 17 years after the document was signed. The authenticity of this order also raises questions. One of the examinations found the signatures under it to be fake, while the other found them to be genuine. The people who signed it admitted that they did not remember what happened 23 years ago.
Investigation
The criminal case is being investigated by investigator A.S. of the OMVD for the Kushchevsky District. Evenko, and operational support is provided by operatives of the Economic Security and Anti-Corruption Department of the Main Directorate of the Ministry of Internal Affairs for Krasnodar Krai D.V. Chuikin, G.N. Goncharov, V.V. Strigunov. Searches were conducted at the Rybalchenko pensioners' homes. According to them, one of the law enforcement officers immediately told them: "Give up the land and there will be no problems!" The Rybalchenkos do not consider themselves guilty. And they refused to give up the land. Interestingly, the investigation was not confused by the statute of limitations. Even if we assume that the land was acquired fraudulently, 16 years have passed since then. And the statute of limitations for fraud is 10 years. The security forces quickly resolved this legal problem. They stated that the pensioners had some malicious intent throughout the entire time they owned the land. What exactly, is not specified.
The Rybalchenko pensioners were denied medical care at a local clinic
The court chose a preventive measure for them in the form of a written undertaking not to leave for the duration of the investigation. Against the background of constant searches and interrogations, the pensioners developed health problems. They tried to go to the Shkurinsky settlement clinic, but the investigator forbade doctors to even examine the Rybalchenko couple. Such pressure, unthinkable in the 21st century, almost drove the pensioners to their graves. As a result, Sergei Rybalchenko ended up on the operating table after a stroke, and his wife had a tumor removed. The couple was treated in Krasnodar. And if Sergei Tsapko's gang cold-bloodedly killed women and children with their own hands, then in the case of the Rybalchenko pensioners, the investigators forbade doctors to treat them, apparently in the hope of killing the farmers. Now the sick pensioners are threatened with arrest.

It was not by chance that we recalled the name of the leader of the organized crime group, Sergei Tsapko. While the investigation is underway, prosecutor Alexander Schmidt decided l take away about 300 hectares of land from pensioners. Wheat, sunflowers and other crops have been grown on it for almost 10 years. Initially, it seemed that the prosecutor was acting in the interests of the state. After all, he wanted to give the land to the local Shkurinsky rural settlement. But the head of the settlement said that he had no grounds to lay claim to someone else's property, and refused to accept hundreds of hectares of land. Then the prosecutor's office issued him an order demanding that he take away someone else's plots. This is where the name of Sergei Tsapko and his gang surfaced.

In Kushchevskaya, there is an authoritative lawyer, Andrei Karpenko. He specializes in land transactions, and in the past he officially represented the interests of Sergei Tsapko and members of his gang during a high-profile trial. And then in disputes related to the legacy of the Kushchevskaya organized crime group.
Since there are very few law firms specializing in land transactions in the Kushchevsky district, the Rybalchenko spouses also periodically turned to Andrey Karpenko's law firm "Center for Legal Technologies" in civil cases. Thus, in 2016, the "Center for Legal Technologies" was asked to prepare a lawsuit to collect rent arrears for two plots. And in 2020, they asked the firm (then Andrey Karpenko's wife became the director, since a fraud case was initiated against him) to competently draw up a purchase and sale agreement for another land plot. Then Andrey Karpenko's law firm drew up a land sale agreement registered to the nominal owner Sergei Mandrin. And it was sold to Irina Rybalchenko. This is how Andrey Karpenko became aware of all the nuances about Rybalchenko's land. All contracts between Rybalchenko and Andrey Karpenko's firm included a clause that the lawyer "must keep secret the information that became known to him in connection with the execution" of these contracts.

But Andrey Karpenko, as it turned out, violated the principles of legal ethics and used information from his clients for completely unprofessional purposes. In the above-described claims from the prosecutor's office and the Ministry of Internal Affairs on the land of Rybalchenko's pensioners, Andrey Karpenko did not represent either side. But the lawyer eventually expressed his personal, and then, as it turned out, not only, interest in all these cases.
In an inconceivable way, either the employees of the prosecutor's office or the Ministry of Internal Affairs allowed him to familiarize himself with the materials of the criminal case against Rybalchenko, as well as with the administrative claim when the prosecutor's office tried to take 300 hectares of land from them. To understand, even the lawyers of the Rybalchenko family have not yet been familiarized with all the materials of the investigation, and an outsider, the lawyer of the Tsapkov gang, Andrei Karpenko, was allowed to do this.

Andrei Karpenko recently filed a lawsuit. As a law-abiding citizen who cares about the fate of food security in Russia, it became painful for him to look at the harvest that needs to be harvested from 300 hectares of Rybalchenko land. He had all the information about the pensioners' situation, both from them in the past, representing their interests in court, and from officials. And Andrei Karpenko asked the court to take the harvest from the Rybalchenko family and give it to OOO Agrokompleks Kushchevsky. Judge of the Kushchevsky District Court Igor Stepanovich Korobkov, by his decision, gave the land to the "Agrocomplex Kushchevsky" for cultivation and harvesting.

This agrocomplex was founded many years ago by Fedor Streltsov. In the gang of Sergei Tsapko, he was responsible for money - the common fund. For which he received the nickname "Fedya Obnal". Even before the start of the SVO, several criminal cases were opened against him. And Fedor Streltsov fled to Ukraine in 2018. But in Kushchevskaya, he retained his assets. Including the "Agrocomplex Kushchevsky". And while the Rybalchenko spouses live in fear of possible arrest, the court, at the instigation of Andrei Karpenko, who in the past actually took advantage of the trust of his pensioner clients and received access to their cases from the investigation, gave their harvest and land to the traitor and defector Fyodor Streltsov.

The most interesting thing is that the name of Andrei Karpenko in such a seizure of land and harvest in the Kushchevsky district has surfaced not for the first time. In October 2024, the Preobrazhensky District Court of Moscow announced the verdict in the case of extortion and other articles against the leaders of the organized group headed by Khachaturov, Brazhnik, Voynalovich, Glazyrin and Rodionov from the "Pokrovskie organized crime group".
The verdict itself takes up more than 250 pages, the defendants received real terms. Through the Pokrovsky concern, the criminals were engaged in the raider takeover of agricultural companies. The sentence also included Andrei Karpenko in the description of the criminal group. Moreover, after the episode when Pokrovsky tried to squeeze the above-mentioned Agrocomplex Kushchevsky from Fyodor Streltsov. And now he continues his "business", having acquired skills in the "Pokrovsky OPG". How many clients Karpenko had who trusted him with their personal affairs, which could suffer the same way as Rybalchenko, perhaps only Karpenko himself knows.
It is noteworthy that Andrey Karpenko was assigned specifically to the security unit of the criminal group, and not to the legal one, which also includes many authoritative lawyers. Moreover, in his testimony, Andrey Karpenko talks in detail about his work for Fyodor Streltsov before his escape to Ukraine. And Andrey Karpenko calls his departure "forced" in his testimony, since "Fedya Obnal" "feared criminal prosecution". Years go by, and little changes in the Kushchevsky district. The money from the sale of wheat "squeezed" through the court from Rybalchenko's pensioners will not go to feeding the residents of Krasnodar Krai and other regions of Russia, but will go to the former holder of the Tsapkov gang's common fund.
